Portal Terms and Conditions

The parties to this agreement are any customer who uses the Decision Portal (The User) and Historic Environment Scotland (the Provider).

The Decision Portal are those pages on this website which are clearly labelled "Decisions Portal".

These Terms and Conditions apply solely to the Decision Portal Pages. The Historic Environment Scotland Website Terms and Conditions also apply and are incorporated into your use of the Decisions Portal.

Data Provision

Data provided on this site is intended for information only. Professional advice should be sought from us at the earliest opportunity of planning proposed development or land management changes, or any other activity that could potentially affect a heritage asset. Please contact us for further advice as proposed development may require permissions in advance of any works.

Data Protection and Privacy

We will process your personal information appropriately and legally in accordance with the Data Protection Act 1998, the National Fraud Initiative and other relevant legislation. The details you have provided will only be shared where the law allows.

Any information which is voluntarily submitted as part of an application will be:

  • processed fairly and lawfully;
  • obtained and processed only for lawful purposes;
  • adequate, relevant and not excessive;
  • accurate and, where necessary, kept up-to-date;
  • not kept for longer than is necessary;
  • processed with regard for the rights of the data subjects;
  • protected against unauthorised or unlawful processing and against accidental loss or damage; and
  • transferred only to countries with similar regulations in force.

If we agree that the information is inaccurate or incomplete, we will rectify any inaccuracies to ensure compliance the Data Protection Act.

You should be aware that we may be required to disclose your personal information without your consent for the purposes of preventing or detecting crime/fraud or apprehending and prosecuting offenders (for example to the Police or as part of the National Fraud Initiative) or where we have a statutory duty to do so.

Spatial Downloads

Spatial Downloads includes heritage data in a spatial format. All spatial downloads, except for Historic Landuse Assessment data, are available for use under the Open Government Licence for public sector information.

Please use the following attribution statement when re-using data licensed under the Open Government Licence: Contains Historic Environment Scotland and OS data © Historic Environment Scotland and Crown Copyright and [database right] (year), licensed under the Open Government Licence v3.0.

Historic Landuse Assessment data is provided under an End User Licence, which you must register for.

Intellectual Property Rights (IPR)

Intellectual Property Rights for documentation supplied as part of an application are not held by Historic Environment Scotland. Permission to use this data must be sought from the relevant party.

Intellectual Property Rights for all maps are held by Ordnance Survey. Please see Use of maps section below for terms and conditions. Permission to use this data in any other way must be sought from the relevant party.

All other Intellectual Property rights in the material on this site belong to us.

Use of Maps

Use of maps, either on screen or in documents, is subject to the following terms and conditions.

You are granted a non-exclusive, royalty free, revocable licence solely to view the Licensed Data for non-commercial purposes for the period during which Historic Environment Scotland makes it available.

You are not permitted to copy, sub-license, distribute, sell or otherwise make available the Licensed Data to third parties in any form.

Third Party rights to enforce the terms of this licence shall be reserved to Ordnance Survey.

Use of Data

The material may be downloaded to file or printer for private or non-commercial uses only. You are not permitted to modify, adapt, arrange, alter, adjust or make any additions to any material.

Permission to reproduce copyright material on this site does not extend to any material identified as being the copyright of a third party.

Any other proposed use of the material is subject to the approval of Historic Environment Scotland. Please contact us to make an application.
